Eligibility for Trademark Registration

  • Any individual, company, or firm can apply for trademark registration in India, provided:
    1. The trademark must be distinctive and not similar to existing trademarks.
    2. The trademark must be used in commerce related to goods or services.
    3. The mark should not be deceptive, offensive, or descriptive of the goods/services.

Trademark Registration Process in India

Step 1: Trademark Search

  • Before applying, it is advisable to conduct a trademark search to ensure that no identical or similar trademark is already registered. This search can be done through the official website of the Controller General of Patents, Designs and Trademarks.

Step 2: Filing the Application

  • The application for trademark registration can be filed online through the IP India portal or manually at the nearest Trademark Office.
  • Form TM-A is used for filing the application.
  • Provide the following details:
    • Applicant’s name and address.
    • A clear representation of the trademark (word, logo, or design).
    • Goods or services the trademark will cover (categorized under NICE Classification).

Step 3: Examination by Trademark Office

  • The Trademark Office examines the application to ensure that it meets all legal requirements.
  • If there are no objections, the trademark will be accepted and advertised in the Trademark Journal.

Step 4: Publication in the Trademark Journal

  • The trademark is published in the Trademark Journal, giving third parties an opportunity to oppose the registration.
  • If no opposition is filed within 4 months, the trademark is registered.

Step 5: Issuance of Registration Certificate

  • Upon successful registration, the applicant receives the Trademark Registration Certificate.

Step 6: Renewal

  • A trademark registration is valid for 10 years, after which it can be renewed indefinitely for subsequent periods of 10 years.

Documents Required for Trademark Registration

  1. Trademark logo or wordmark (graphically represented).
  2. Applicant’s details (individual, company, or partnership).
  3. Proof of use of trademark (if applicable).
  4. Business registration documents (for companies or firms).
  5. Signed Power of Attorney (if filing through an agent).
  6. Address proof (e.g., Aadhaar card, passport, utility bills).

Trademark Classes in India

Trademark goods and services are divided into 45 classes based on the NICE Classification System.

  • Class 1-34 are for goods (e.g., electronics, clothing, food products).
  • Class 35-45 are for services (e.g., legal services, education, entertainment).

Fees for Trademark Registration

  • The filing fee depends on the type of applicant:
    • For individuals, startups, or small enterprises: ₹4,500 per class.
    • For others (companies, LLPs, etc.): ₹9,000 per class.

Fees are subject to change, and additional costs may apply for legal assistance or trademark oppositions.
